Sinossi. Il commento analizza la decisione sul caso Bervidi, in cui la Corte di Giustizia ha rico-nosciuto la configurabilità della discriminazione indiretta per associazione ed esteso il diritto agli accomodamenti ragionevoli ai prestatori di assistenza. Dopo aver ricostruito il caso, il commento si concentra sull’analisi del rapporto tra accomodamento ragionevole e giustifica-zione alla discriminazione indiretta e sulla nozione euro-unitaria di caregiver.

Abstract. This commentary analyzes the Court of Justice’s decision in the Bervidi case, in which the Court recognized the applicability of indirect discrimination by association and extended the right to reasonable accommodation to caregivers. After reconstructing the case, the commentary focuses on the analysis of the relationship between reasonable accommodation and the justification of in-direct discrimination, as well as on the EU-wide notion of caregiver.
