Sinossi. La pronunzia affronta la questione della legittimazione del lavoratore a proporre azione nei confronti del datore in caso di omissione contributiva, quando ancora non abbia richiesto il pensionamento. La Corte, riformando la pronunzia della Corte d’appello, ritiene che il lavoratore abbia comunque interesse ad agire anche se manchi un pregiudizio concreto, perché il diritto del singolo all’integrità della propria “posizione contributiva” non richiede che sia provata l’attualità del danno. Proiettandosi anche sul giudizio di rinvio la Corte si propone nelle motivazioni di formulare una sorta di compendio che dia sistematicità alla materia, anche in relazione alla necessità di integrare il contraddittorio con l’INPS nei casi in cui venga in rilievo un’omissione contributiva. La nota condivide gli esiti cui giunge la Corte, ma non le motivazioni, ritenendo che la nozione di posizione contributiva non sia necessaria a descrivere gli effetti dell’omissione, una volta che si sia adottato per tutti i lavoratori il sistema contributivo.  

Abstract. The ruling addresses the issue of the worker’s legitimacy to bring action against the employer in the event of failure to pay social security contributions, when he has not yet requested retirement. The Court, reforming the ruling of the Court of Appeal, believes that the worker still has an interest in taking action even if there is no concrete prejudice, because the individual’s right to the integrity of their “contributory position” does not require that concreteness be proven of the damage. Also focusing on the following fases, the Court aims to formulate a sort of compendium that gives systematicity to the matter, also in relation to the need to integrate the trial with the INPS in cases where omission in paying social contributions is highlighted. The note approves the findings reached by the Court, but not the reasons, believing that the notion of contributory “position” is not necessary to describe the effects of the omission, once the “contributory system” has been adopted for all workers in calculating the social security pensions.
