Sinossi. Il contributo esamina l’evoluzione della distinzione fra ipotesi di illegittimità del licenziamento che ricadono nella tutela reintegratoria e ipotesi che ricadono nella tutela indennitaria, con particolare riferimento alle modifiche normative e agli itinerari della giurisprudenza dell’ultimo quindicennio.

Abstract. The contribution examines the evolution of the distinction between hypotheses of illegitimacy of the dismissal which fall within the reinstatement protection and hypotheses which fall within the indemnity protection, with particular reference to the regulatory changes and the itineraries of the case law of the last fifteen years.
